A Conwy pensioner who molested and photographed an 11-year-old girl has lost an Appeal Court bid to clear his name.
Kenneth Charnley, 67, of Plas Hall Hotel, Dolwyddelan , was caged for two years and 10 months at Mold Crown Court last year .
Charnley pulled the school girl on to his knee and assaulted her, Mr Justice Openshaw told London’s Appeal Court today.
He was also found to have a “large number” of photos of his victim.
Whilst accepting that he had taken “numerous” pictures of the girl, Charnley denied assaulting her.
He said he was interested in photography and knew that television companies were “always looking for photogenic children”.
It was just a “coincidence” that a number of the photos showed her crotch and knickers, he claimed.
But he was convicted on March 9 last year of sexual assault of a child under 13.
He was also found guilty of two counts of taking, and three of possessing, indecent photos of a child.
Charnley appealed against his sexual assault conviction today, claiming it was ‘unsafe’.
He said it was wrong that other photos he had taken of the victim, which had no conceivable sexual element, had been put before the jury.
But Mr Justice Openshaw said the conviction was “entirely safe”.
The judge, who was sitting with Lord Justice Jackson and Judge Stephen Kramer QC, said he had seen some of the images himself.
They showed the girl in “sexually provocative” poses which were “wholly inappropriate” for a man in his 60s to be taking of an 11-year-old.
Putting the photo collection before the jury could not “possibly affect the safety of the conviction”, ruled the judge, dismissing the appeal.
