A FORMER army cadets sergeant engaged in sexualised messages with a girl aged just 13.
Defendant Nathan Peter Young, now 22, was aged 19 at the time.
Young of Abergele Road in Bodelwyddan, told police how he believed that she had been 18.
They had exchanged Facebook messages and she had agreed at his request to send him a photograph of her naked breasts.
One the one occasion when they did meet he tried to kiss her and she pushed him away.
There had been no other physical contact between them, Mold Crown Court was told.
Young admitted a charge of inciting a girl aged under 16 to engage in a sexual act and was placed on a three year community order.
He was ordered to following the community sex offender treatment group work programme.
The defendant must register with the police as a sex offender for five years.
A five year se.ual harm prevention order was made under which he is not to take part in any community social activities, paid or unpaid, in any role where there was a likelihood of contact with females under 16.
He is not to have any contact with the girl involved.
Judge David Hale told him: “You behaved in a very stupid way.”
It was not in the same league of seriousness of many cases of its type.
It did not go very far although there was discussion about sexual matters, but the judge said he regarded it more as banter rather than any serious attempt to pursue a relationship.
There was no evidence that he knew she was 13 at the time but at the same time it was patently obvious that he had failed to make any proper enquiries about her age.
However, there was every indication that he had “grown up quite a lot” since the offences took place.
“I hope you are able to put this behind you and get on with your life,” he said.
Judge Hale said that he had been able to speak to the girl on the day of the intended trial and he took the view that she was a “really nice” girl who had not been unduly affected by what had happened.
Prosecuting barrister Simon Rogers told the court that a friend of the girl was concerned about the relationship and told her mother.
An investigation showed that there had been contact via Facebook and messages of a sexual nature had been exchanged.
He had discussed him and a friend having intercourse with her.
They had met up once when her parents were away but a witness told how when he tried to kiss she pushed him away.
Interviewed, he denied seeing the photograph of the girl’s naked breasts or that he had texted her saying he wanted sex with her.
Defending barrister, Simon Killeen, said that it was particularly relevant that nothing happened in terms of touching.
The text messages of a sexual nature occurred within a very few days.
He said the offences went back some time, about 18 months ago, and he said he questioned the necessity for a sexual harm prevention order or the need for supervision.
