A SEX offender has been spared jail after downloading indecent images of children for his own “perverted pleasure”.
Brian Martindale, of Tan Lan, Ffynnongroyw, Holywell, had pleaded guilty at an earlier hearing to seven counts of downloading indecent images of children – some as young as six.
The offences had taken place between June, 2011 and June, 2015.
Judge David Hale, sitting at Mold Crown Court, told Martindale, 50, he had pleaded guilty to “disgusting offences”.
He placed him on a three year sexual offender treatment programme, adding: “It is important the public understands this is no soft option”.
He said the programme was significantly effective, but warned Martindale he would go straight to prison if he failed to comply.
Brett Williamson, prosecuting, said police executed a search warrant at Martindale’s home in June, 2015.
He made an admission to officers, saying: “That’s everything now.
“Everything is on the big laptop and there might be some on the broken laptop.
“I have not met or touched any children, I’m not into that.
“You have got enough on me now.”
Despite making his admission, Martindale denied the allegations during a police interview, saying he had only searched for adult porn and the sites he went on had a “mind of their own”.
Mr Williamson said the offences were aggravated in that Martindale had “specific software” to download some of the images and videos – 16 of which were of category A.
Philip Clemo, defending, said Martindale was a hard working man with no previous convictions and he was someone who was committed to the treatment programme.
Judge Hale, said: “These are disgusting offences that the public finds quite rightly extremely offensive.
“Somewhere in the world some child has suffered for your perverted pleasure.
“We will probably never know who they are and most of them will never get over it.
“And there you are pressing buttons looking at what you like.”
He added: “There is no suggestion you would touch children yourself, but you were quite prepared to let others do it for you.”
Judge Hale placed Martindale on a three year treatment programme saying it would help with “ridding” him of his interest.
He also put him on a sexual harm prevention order for five years and a 50 day rehabilitation order.
He will also sign as a sex offender for the next five years and was ordered to pay £535 in costs.
