A MAN became aggressive towards the police after he was stopped for poor driving, magistrates heard.
Justin Espie, prosecuting at Wrexham Magistrates Court, said David Procter, 31, was spotted driving a BMW car aggressively onto the A483 at about 10.30am on August 10.
The officer was initially going to stop Procter, of Glan Aber Close, New Rhosrobin, and offer him advice, but Procter started driving so aggressively that the officer was travelling at 80mph to pursue him.
As Procter approached a junction for Rhos, he indicated left then right then left again.
He later indicated for Rhos but moved left for Rhostyllen.
Procter continued to accelerate hard and failed to stop when the officer flashed his lights.
The officer tried to make a controlled stop by going in front of the car, but the defendant pulled out and accelerated away.
The officer eventually caught up with Procter, who drove into a driveway. He had reason to believe Procter was driving under the influence and blocked the driveway as he tried to reverse out.
He was shouting Mr Espie said, and made intimidating comments to the officer.
Procter then asked the officer if he was being detained, otherwise he would leave.
The officer then produced a breathalyser and Procter began swearing and took hold of the hand in which the officer was holding the breathalyser and pushed his head towards the officer, who believed he was going to be assaulted.
Force had to be used to restrain Procter, who was arrested and later charged.
He pleaded guilty to using threatening/abusive words/ behaviour, resisting an officer in the execution of his duty and failing to stop when required.
Laura Preston-Hayes, defending, said Procter adamantly denied driving in any manner below the reasonable standard.
He had indicated in the way he did to let the police officer know he had not used his own indicators.
That prompted the officer to follow him and try to stop him.
Miss Preston-Hayes added Procter had not been charged with dangerous or careless driving and had no previous convictions for driving matters.
Procter went to his girlfriend’s driveway and the officer came towards him.
Matters escalated when the officer pushed the breathalyser unit in Procter’s face, the court heard.
He thought this was inappropriate and there was no indication that he would need one, Miss Preston-Hayes said.
He fully accepted he was abusive because he didn't know what was going on.
Matters escalated again, Miss Preston-Hayes said, when Procter was restrained, which he did not think was necessary.
Procter accepted he then lost his temper, she added.
Magistrates fined Procter £240 and ordered him to pay £85 in prosecution costs and a £20 surcharge.
