Rhyl,North Wales - Man told to pay £1000 after assault on disabled man

A Rhyl man convicted of assaulting a disabled man escaped immediate imprisonment but must pay his victim £1,000 compensation.

Mold Crown Court was told Kane Mitchell, aged 23, had denied a charge of assault, occasioning actual bodily harm, on a vulnerable man whose prosthetic leg had been damaged in the incident.

But he had been convicted at an earlier trial.

Mitchell of Mill Bank Road in Rhyl, received an eight month prison sentence, suspended for 12 months.

He must carry out 150 hours unpaid work and remain indoors for the next three months between 6.30 p.m. and 5 a.m..

In addition, he was ordered to pay his victim £1,000 compensation for the injuries caused and the damage to his personal property.

Judge Niclas Parry told him: “You are being given a chance. You have been fortunate.”

Sentencing the defendant, the judge said: “Yours were the actions of a bully.

"You attacked a man who was clearly disabled.
“The attack took place in disabled toilets. It was a sustained attack involving three blows.

“You should have pleaded guilty.”

He said that the victim had to re-live his experience in court which had been difficult for him.
Prosecuting barrister Anna Price said that the victim felt very nervous about going out as a result of the attack upon him, his sleep had been affected, and he suffered flash backs. 

His prosthetic leg had been damaged in the incident and had cost £875 to replace.

Defending barrister Simon Killeen said that there was another side to his client’s character.

He had been accepted by the International Citizens’ Service to do voluntary work abroad for ten weeks, starting in September.
Mitchell was working hard as a labourer and if he was allowed his liberty he would be able to compensate the complainant.
