A distraught mum has slammed the justice system after a paedophile assaulted her nine-year-old daughter just days after walking free from court for child porn.
Adrian David Saunders, 34, of Ffordd Garnedd, Y Felinheli, was spared jail again yesterday after sexually assaulting the girl on December 3.
Three days before the assault, on November 30, Saunders had been sentenced for possessing 800 sick images of children, but had escaped jail.
On Tuesday, he walked free from court again after Judge Philip Harris-Jenkins decided against a prison sentence for the assault.
Saunders had been caught on CCTV rubbing the bum of the girl, after checking over his shoulder around six times.
"It's absolutely sickening"
The victim’s mum, who cannot be named for legal reasons, said the court’s decision had left her feeling “helpless”.
She said: “I’m so upset and angry about it. I cannot believe he has got away with it.
“I only live five minutes away from the hostel he will have to stay in. I’m scared what I will do if I see him after what he did to my little girl. It’s just absolutely sickening.
“If he had been sentenced to jail in November, he never would have been able to attack my girl.
“He got away with it last time because it took them so long to prosecute him. That is not the public’s fault.
“The simple fact is he walked out of court on November 30 and then days later did this to my daughter.
“I will be appealing the sentence. They definitely have not heard the end of it.”
Saunders, an Army veteran, had his computer seized by police in July 2013.
They found 29 images in category A, the worst category, 10 in category B, and 761 in category C.
The majority of the images were of girls aged between seven and 14.
Embarrassed
Peter Rogers, prosecuting, said Saunders was playing card games with the girl before the assault on December 3.
He said to the girl, “I can see your pink knickers”, which Caernarfon Court heard left the girl feeling “embarrassed”.
Undeterred, Saunders claimed the girl had something on her bottom and rubbed it.
Minutes later, the girl asked her grandmother if she could go home, where she asked if she had anything on her.
Judge Harris-Jenkins was shown CCTV footage of the sexual assault, but decided against jailing Saunders.
John Wyn Williams, defending, said Saunders had admitted the offence at the earliest opportunity and “knew that he required structured and significant help”.
Mr Williams said: “His increasing run-ins with the law only begin when he leaves the Army, and it is fair to say he has struggled to adapt since then.”
Judge Harris-Jenkins gave Saunders a three-year community order and a curfew for four months.
Saunders will be made to sign a sexual harm prevention order and the sex offenders register.
