A MAN prosecuted for downloading images of child sexual abuse for a third time has been jailed for two years and eight months.
Peter Smith, 35, was at a high risk of re-offending, a court was told yesterday.
Attempts had been made to help him in the past, but Judge Gaynor Lloyd said he appeared to have been paying lip service to it.
A probation report said there was a likelihood of “contact offences” unless his behaviour was properly and thoroughly addressed.
Smith, of Phillips Road in Gwersyllt, claimed it had been a cry for help and that he did not get any sexual gratification from viewing them but Judge Lloyd said he had been doing it for his own sexual gratification.
Smith was ordered to register with the police as a sex offender for life. He was also made the subject of a fresh Sexual Harm Prevention Order which will last indefinitely.
Mold Crown Court was told Smith was prosecuted in 2005 and 2010 for similar offences. He received a suspended sentence in 2010.
But in May of last year police executed a search warrant at his home and found hundreds of child abuse images and films, some of which involved sex acts between humans and animals.
Smith admitted 13 offences – three charges of making indecent images of category A, B and C by downloading them from the internet, and possessing 3,957 such images, 555 of them of the worst possible kind at category A.
He admitted possessing 677 indecent movies – 206 at category A – and possessing 42 extreme movie images involving sexual acts between humans and animals.
Smith admitted breaching a Sexual Offences Prevention Order imposed at Mold Crown Court in August 2010 in that between May 2011 and May 2015 he used the Internet for purposes of viewing and obtaining indecent images of children.
In his interview, he said he was glad he had been caught and he did not have any sexual gratification from it. He said he did not know why he did it, but knew it was not good. It was, he said, a cry for help.
He could not carry on and “wanted to be normal” said prosecutor Emmalyne Downing.
Andrew Green, defending, said Smith was being supported by his mother and his fiancée who knew a different side to him.
Smith recognised he had a problem, knew it was wrong, but when he suffered from depression and traumatic life events seemed driven almost by an irresistible urge to seek out the unlawful material.
It was hoped he would receive assistance in custody.
Judge Lloyd said the pre-sentence report showed Smith admitted downloading them for his own sexual gratification. He had failed to respond to previous attempts to help him.
Smith admitted his behaviour, but was some way off accepting full responsibility. There was clear concern he was paying “lip service” to avoid a custodial sentence.
Commenting on the sentencing of Smith of Gwersyllt, PC Gaynor Humphreys said: “Incidents of this nature are taken extremely seriously by North Wales Police and those found engaging in such behaviour will be pursued and brought before the courts. We welcome the sentence.”
