A man who bit his former partner on the nose in a terrifying attack then brandished two kitchen knives in a stand-off with police.
During the stand-off, David Anthony Smith suggested that someone would die that night, either himself, his former partner or one of the police officers.
Smith, 28, of Mancot Way in Mancot, Flintshire, admitted affray, assault and criminal damage and was jailed for 12 months at Mold Crown Court today.
Judge Niclas Parry, who said he was staggered that the biting had been charged as common assault by the CPS, said Smith was a man who would use violence to control partners.
“This was a sustained and terrifying incident,” he said.
It included biting his former partner’s face and punching her to the mouth, causing injury.
Police officers were involved in a 20-minute stand-off with Smith at his mother’s home as he brandished the knives.
Prosecuting barrister Michael Whitty said the couple split up at the end of last year.
On January 13, the 24-year-old victim agreed to take the defendant to her home to get his belongings.
But, as she then drove him to his mother’s home in Mancot, he became more and more wound up.
“At one point, he took hold of the steering wheel and shook it as she drove along,” said Mr Whitty.
Smith became angry about a mobile phone message she had received and, despite her reassurance, he was screaming and crying.
He got out of the car and stamped on the phone at one stage.
As she arrived at his home, she sounded the horn to try to get assistance, but he punched her to the lip.
She was extremely upset and pleaded with him to get out of the car, but he pulled her head back and bit her to the nose.
He stopped her getting out of the car as she continued to sound the horn to attract attention.
In an effort to placate him, she agreed to go to his mother’s address to get her wound cleaned up.
She then locked herself in the car, intending to drive off, but Smith had taken the keys.
He then smashed a side window and the windscreen with a plant pot, covering her with glass.
As police arrived, Smith asked her to get into his mother’s car, despite the fact that he had been drinking and was a disqualified driver.
There was then a 20-minute stand-off in which the defendant was threatening towards the police and his former partner, and threatened to harm himself.
“If you come near me, I am going to kill myself,” he said.
He cut his own arms as police tried to negotiate with him, but then calmed down and was arrested.
Defending barrister Charles Lander produced a letter written to his client by the victim and a reference from a former partner, who is the mother of his child.
What upset him most was that he would be parted from his daughter, although he appreciated that was his own fault, said Mr Lander.
He had mixed alcohol and cocaine at the time of the incident, he said.
Following the sentencing, PC Cath McHarrie at Deeside police station said: “I hope today’s sentencing encourages other victims of domestic abuse to come forward.
“Domestic abuse is a crime and with our partners we will do all we can to eradicate it from our communities and vigorously pursue those who commit these acts.
“We will continue to work with our partners, victims and offenders to raise awareness of domestic abuse and strive to make our communities safer.”
