A man who text his ex-girlfriend threatening to murder, stab and kill her and considered a “serious risk” to her, was spared jail by magistrates today.
James Spencer Haddock, of Victoria Way, Bagillt , was given an eight-week sentence suspended for 18 months on the understanding he carries out rehabilitation courses.
It followed a series of texts the 21 year-old sent to his former partner on November 24, which put her in fear of her life.
Rhian Jackson, prosecuting, told Flintshire magistrates sitting at Mold, the couple were in a relationship until August of last year.
Two weeks before the incident, she had asked to resume the relationship, he had refused and she had said he would not be allowed to see her son.
It sparked a series of texts where he threatened “I’m going to kill you”, “murder you” and “stab you” said Ms Jackson.
He also told her to “sleep with one eye open” frightening the victim, who told him he was “unstable”.
“He also said he was going to set her dad’s factory on fire and rob it,” said Ms Jackson.
“He also said ‘I’m going to smash your head in.”
As the circumstances were related in court today, Haddock broke down in tears.
A Probation Service report to the magistrates assessed Haddock as a “serious risk of harm to the victim”.
He had admitted sending grossly offensive and menacing messages via a public electronic communications system at a previous hearing.
The court had also heard Haddock claimed he had never intended to hurt her and couldn’t remember sending the texts.
He also suffered from anxiety and depression.
Passing sentence, magistrates chairwoman Helen Paterson said: “This is a serious matter.
“You sent the victim a series of communications which were extreme and caused the victim great fear and distress and clearly passed the custody threshold.
“Because of your early guilty plea we are reducing the sentence to eight weeks and suspending it for 18 months.”
Haddock was also ordered to carry out a 30 days of rehabilitation and a 35 days on an accredited course.
“If you don’t attend these, you will be brought back to court and its more than likely the sentence will be activated,” said Ms Paterson.

He was also ordered to pay £200 in costs and charges.
