Llandudno,North Wales - Jail for homeless Llandudno man who spat at special constable and drank cider in street

Richard Wynne Davies, 45, was in breach of a Criminal Behaviour Order which banned him from drinking in public places, court hears

A 45-year-old homeless alcoholic has been jailed after he caught on CCTV drinking cider which put him in breach of a court order.
Richard Wynne Davies appeared before a special court at Llandudno accused of another breach of the Criminal Behaviour Order which bans him from large areas of the town and from drinking in public places.
A 26-week suspended jail sentence, recently imposed, was activated, and he was given concurrent 12 week term for breaking his order and for common assault which involved spitting at an off-duty Special Constable.
Nia Lloyd, prosecuting, said Davies had been spotted by a CCTV operator when he was sitting on a bench in Mostyn Street, Llandudno, on December 30 drinking from a bottle of cider.
He had spat on the fleece of the “special”, Haydn Roberts-Powell. Davies had struggled and was abusive in the vehicle taking him into custody. He told police “he was drinking in public because he was homeless and had nowhere to go,” said Mrs Lloyd. He had a long record of breaching ASBOs and behaviour orders.
Simon Sargent, defending, said Davies had pleaded guilty at the first opportunity and made full admissions. His friends were other homeless people at Llandudno.
“He didn’t make a nuisance of himself but simply sat on a bench and took one sip of cider and put the top back on,” added the solicitor. “There was no justification in spitting at anyone and he apologises for his behavior.”
When he is released from prison Davies must pay £50 in compensation to Mr Roberts-Powell and £200 in court costs.
Sending him to jail court chairman David Subbachi told him: “We have no alternative.”
