A MAN said to have unusual sexual urges indulged in an indecent act upon himself in the presence of children.
Gary McCallum, 45, was told at Mold Crown Court that there was concern that he could move on to more serious offending.
He was sent on a course to tackle his issues which a judge said would better protect the public, particularly children.
McCallum, of Plas Isaf, Rhosymedre, Wrexham, admitted indulging in a sex act on himself in public at a time when he had been looking at images of child sex abuse on the internet.
Judge Niclas Parry told McCallum that in May of this year, clearly unable to control himself in his urge for sexual gratification, he masturbated in public on two separate occasions.
He was entirely reckless as to the fact that on one occasion a child aged four was in the vicinity and on the following day, two girls under 13 were present.
“You had no regard for the harm and distress you could have caused,” he said.
In the months leading up the offences, the defendant had been viewing sexual images of children as young as three, involving penetrative acts.
The case was aggravated by the fact that he was in possession of moving images of young children and one extreme image involving sexual acts between adults and animals.
“This is an extremely worrying case involving sexual behaviour that is concerning and has the clear potential to escalate,” said Judge Parry.
The judge said the defendant had unusual sexual urges as his behaviour clearly demonstrated.
He had “no boundaries” when the urges struck.
There was also a concern that the sexual acts did not satisfy his urges and the potential for more serious offending was obvious.
The defendant was aged 45 with no previous convictions with a good work record.
He had lost his job and his wife, and had pleaded guilty at the earliest opportunity.
Judge Parry said the choice was stark – custody which would inevitability mean his release back into the community untreated within a matter of weeks or an intensive community order to address his issues.
“That is far more likely to protect the public and children in particular,” he said.
The defendant was placed on a three-year community order with a sexual offender group work programme and rehabilitation.
He was placed on the sex offender register for five years and a five-year sexual harm prevention order was made. McCallum must pay £500 costs.
He admitted two charges of engaging in sexual acts in the presence of children and possessing indecent images of children category A and C and one extreme image.
