A CAKE-loving pensioner has been banned from driving for 18 months.
A court was told yesterday how 80-year-old Haydn Owen Evans wanted a Swiss roll.
He normally cycled to his local supermarket to get one, but it was raining and he did not want to get wet.
So he took the car, despite being a disqualified driver.
Evans, of Caesar Avenue at Oakenholt, Flint, admitted driving while disqualified at Flintshire Magistrates Court at Mold.
In addition to the ban, he was fined £120 with £85 costs with a £30 surcharge after he admitted driving while banned and not having insurance.
Magistrates warned him it was very important that he did not drive in the meantime or he could go to prison.
Prosecutor Diane Williams said that just before 5.30pm on April 28 police stopped a Ford Fusion on the A548.
He was alone in the car and told police it was raining and he needed to go to Morrisons to get a Swiss roll.
“I normally go on a bike but I didn’t want to get wet,” he explained.
It turned out he had been disqualified in March for six months under the totting-up procedure.
Defending solicitor Phillip Lloyd Jones said his client had been out of trouble all his life but was recently disqualified because of the accumulation of penalty points.
“You have heard his explanation. It is not a particularly good one but he certainly avoided getting wet,” he told the court.
“He needed shopping and instead of going on his bike, he decided to drive,” Mr Lloyd Jones said.
Evans realised what he had done was wrong and he had been strongly advised that if he did it again he could face imprisonment.
“He does not want to go prison at this stage in his life.”
