A BLIND man has been found guilty of sending a menacing phone call after threatening to kill a couple and burn their house and campervan.
Magistrates in Prestatyn heard that Rhonda McAdan had suffered angina attacks as a result of the behaviour of 52-year-old James Wyatt and she and her husband Alan had moved from the house in Prestatyn where they had lived for five years.
Mrs McAdan told the court that the incident occurred on November 27 when she received a phone call from Wyatt enquiring about some clothing she had advertised for sale on Facebook but she became concerned when he enquired about a campervan.
She told him she was not selling the vehicle, which was parked out of sight behind the house, but he replied: “Yes you are, I can see it in front of your house.”
Wyatt became increasingly aggressive, swearing and telling her: “I’m going to come over and kill you and your husband.”
When he called back a second time Mr McAdan swore back at him and Wyatt, who is registered blind, having only 20% vision, told him: “I’m going to kill you and burn the house down” adding that he was going to shoot him.
Mrs McAdan told the court she believed that Wyatt, of Cae’r Nant, Prestatyn, must have been given her phone number by a neighbour of her’s with whom he was friendly.
The police traced the call to Wyatt’s phone but he said he had been unable to understand Mrs McAdan’s Scouse accent and that she had first sworn at him.
Wyatt, who denied the offence, said Mr McAdan’s phone number had been on Facebook.
He denied making threats, adding: “She is making a lot of things up; I don’t know why she is saying it.”
Robert Vickery, defending, said it was a case of “ conflicting accounts”, but pointed out that in her formal statement to the police Mrs McAdan had not mentioned the threat to burn her house or campervan, which one would have thought was a significant factor.
But chairman Darren Campbell said the Bench found inconsistencies in Wyatt’s evidence while the McAdans were credible witnesses.
The case was adjourned until April 5 for a pre-sentence report and the court heard that Mrs McAdan wanted a restraining order preventing Wyatt from contacting her.
