He should have been jailed! Alyx Frasier, 26, did not stop and tried to drive the Mazda through a 3ft gap between the car and the hedge
A man trying to get away from police crashed into an armed response unit vehicle on a country road near Rhyl .
The police saw the Mazda coming towards them on Dyserth Road, came to a stop because there was not enough room to pass, and put their blue lights on.
Mold Crown Court heard how defendant Alyx Frasier, 26, did not stop and tried to drive the Mazda through a 3ft gap between the car and the hedge.
He failed to get through and the Mazda ended up stuck - wedged between the hedge and the police car.
Frasier of Bath Street, Rhyl, admitted dangerous driving, no licence and no insurance.
He received a nine month prison sentence suspended for 16 months and he was ordered to carry out 200 hours unpaid work.
Frasier was also placed on a tagged curfew to him indoors between 6.30pm and 6am for the next two months.
The defendant was banned from driving for 16 months and ordered to take an extended driving test.
Judge Niclas Parry said that it was a prolonged piece of bad driving which amounted to a police chase.
He ignored blue flashing lights, went through junctions without stopping, drove on the wrong side of the road and drove at speed in built up areas.
There was a collision with an on-coning police car.
Judge Parry said that Frasier had a poor record but he had pleaded guilty.
He said that the suspended sentence was a far more constructive sentence for the benefit of the public.
If he had been jailed then he would have been released within a matter of weeks.
Emmalyne Downing, prosectuting, told how in the early hours of October 17 police followed the car in Rhyl but it failed to stop.
It drove dangerously and the officers lost the vehicle on a couple of occasions.
But later in Dyserth Road he tried to take the Mazda through a 3ft gap between the police car and the hedge but became wedged.
“The officers realised there was no room for the approaching car to pass, stopped, and illuminated their blue lights,” the prosecutor explained.
Frasier slowed down a little but then speeded up and tried to pass the police.
“There was no room, it was only a 3ft and the vehicle became wedged between the police car and the hedge,” she explained.
He gave no comment in interview.
Simon Killeen, defending, said that it was a stark choice for the court - custody or restrict his liberty within the community.
