THE sentence given to a man who carried out a “gross” sex attack on a sleeping woman has been almost halved by leading judges on appeal.
Joyan Abedin, 46, was living in Brook Street, Llangollen, in October 2014, when he forced his unwanted attentions on a “totally drunk” woman.
Abedin, now of Hunton Street, Tower Hamlets, east London, fled Wales before he could be arrested for assaulting the woman, who was less than half his age.
He was tracked down and the married father of three was jailed for 20 months at Mold Crown Court in June, having pleaded guilty to sexual assault.
But senior judges at the Criminal Appeal Court in London reduced that term to 12 months.
Mrs Justice Thirlwall and Mrs Justice Elisabeth Laing heard that Abedin “tried it on” with his victim who was in her 20s.
She made it clear she wasn’t interested but, after she fell asleep, he groped and performed a sex act on her.
When the woman awoke to find herself being assaulted, she left angrily and reported what had happened to the police.
Slamming Abedin’s behaviour, Mrs Justice Laing said: “He tried it on at a time when she was totally drunk.
“She made it clear that she did not want any form of sexual contact with him... she could not have been consenting because she was asleep.
“She trusted him to behave and he abused that trust, deciding to please himself sexually, whatever the consequences. He did not understand the appropriate boundaries when it came to sexual contact with women.”
Lawyers for Abedin argued his sentence was far too long and ought to be cut.
Mrs Justice Laing said: “There was no clear evidence that he had touched her genitals, but the act he carried out on her was as gross as it gets short of that.”
But, allowing his appeal, she concluded:  “The correct sentence would have been one of 18 months before giving full credit for a guilty plea.
“The upshot is that the sentence is reduce to one of 12 months’ imprisonment.”
